Privacy Policy

The JMMB Joan Duncan Foundation (“us”, “we”, or “our”) operates the Conversations for Greatness mobile application (the “CFG App”).

We respect your privacy and are committed to protecting your personal data. This privacy policy will inform you as to how we look after your personal data when you visit our CFG App (regardless of where you visit it from) and tell you about your privacy rights and how the law protects you.

IMPORTANT INFORMATION AND WHO WE ARE

This privacy policy aims to give you information on how we collect and process your personal data through your use of the CFG App. The CFG App is not intended for children (anyone under the age of 18 years) and we do not knowingly collect data relating to children. If you are a parent or guardian and you are aware that your child has provided us with personal data, please contact us. If we become aware that we have collected personal data from children without verification of parental consent, we take steps to remove that information from our servers.

1. IMPORTANT INFORMATION AND WHO WE ARE

The JMMB Joan Duncan Foundation is the controller and is responsible for your personal data.

2. END USER LICENSE AGREEMENT (EULA)

By using the CFG App, you agree to the following terms of the End User License Agreement:

Prohibited Content and Conduct:

The CFG App does not tolerate objectionable content or abusive users. Objectionable content includes, but is not limited to, hate speech, harassment, explicit material, discrimination, or content that violates the rights of others.

Content Filtering:

Automated and manual methods are in place to filter and remove objectionable content. Content is monitored to ensure compliance with these terms.

Reporting Mechanism:

Users may flag objectionable content directly within the CFG App using the provided reporting tools. The reporting feature is accessible in the app menu or by tapping the flag icon associated with any content.

Blocking Abusive Users:

Users have the ability to block abusive users within the app. Blocked users will no longer be able to interact with or view the blocking user's content.

Response to Reports:

All reports of objectionable content will be reviewed within 24 hours. If content is found to violate these terms, it will be removed, and the offending user will be ejected from the CFG App.

Termination:

We reserve the right to terminate access to the CFG App for users who violate these terms, including the posting of objectionable content or abusive behavior. By continuing to use the CFG App, you confirm that you have read, understood, and agreed to this EULA.

3. CHILD SAFETY POLICY

We are committed to ensuring a safe and secure environment for all users of the CFG App. Our Child Safety Policy outlines our measures to prevent abuse, our content moderation practices, and our compliance with child safety regulations.

4. THE DATA WE COLLECT ABOUT YOU

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity Data: first name, maiden name, last name, username or similar identifier, marital status, title, date of birth and gender;
  • Contact Data: billing address, delivery address, email address and telephone numbers;
  • Technical Data: internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the CFG App;
  • Profile Data: your username and password, your interests, preferences, feedback and survey responses;
  • Usage Data: information about how you use our CFG App, products and services;
  • Marketing and Communications Data: your preferences in receiving marketing from us and our third parties and your communication preferences.
5. HOW IS YOUR PERSONAL DATA COLLECTED

We use different methods to collect data from and about you including through:

  • Direct interactions: You may give us your Identity and Contact Data by filling in forms or corresponding with us by post, phone, email or otherwise.
  • Automated technologies or interactions: We automatically collect Technical Data about your equipment, browsing actions, and patterns each time you visit the CFG App.
6. HOW WE USE YOUR PERSONAL DATA

We will only use your personal data when the law allows us to do so. Most commonly we will use your personal data in the following circumstances:

  • Where you have consented before the processing;
  • Where it is necessary for our legitimate interests and your interests and fundamental rights do not override those interests;
  • Where we need to comply with a legal or regulatory obligation.
7. DISCLOSURES OF YOUR PERSONAL DATA

When you consent to providing us with your personal data, we will also ask for your consent to share it with:

  • Internal Third Parties: other companies in the JMMB Group based in Jamaica;
  • External Third Parties: service providers based in other countries who provide IT and system administration services;
  • Professional advisers: including legal services providers in Jamaica.
8. DATA SECURITY

We have implemented appropriate security measures to protect your personal data from unauthorized access or disclosure.

9. DATA RETENTION

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for any legal, regulatory, tax, accounting or reporting requirements.

You have the right to:

  • Request access to your personal data;
  • Request correction or erasure of your personal data;
  • Object to the processing of your personal data;
  • Request restriction of processing;
  • Request the transfer of your personal data;
  • Withdraw consent at any time.

  • Consent: processing your personal data where you have signified your agreement by a statement or clear opt-in.
  • Controller: the person responsible for determining the purposes and means of processing personal data.
  • Processor: the person processing the data on behalf of the controller.
